1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your access to and use of the website operated by BUF Supps LLC, a Florida limited liability company (“BUF Supps,” “we,” “us,” or “our”), and your purchase of any products offered through it. By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree, do not use this website.
2. Eligibility
This website and all products sold on it are available only to individuals who are at least 21 years of age and who are qualified purchasers acting on behalf of laboratories, research institutions, or professional research activities. By using this website you represent and warrant that you meet these requirements.
3. Research Use Only
All products sold by BUF Supps are laboratory research chemicals intended strictly for research use only (RUO) within the meaning of 21 CFR § 201.128. Products are not intended for, and must not be used in or on: humans, animals, food, drugs, medical devices, cosmetics, household applications, or any diagnostic or therapeutic purpose.
By purchasing, you attest that: (a) you are a qualified researcher or are purchasing on behalf of an entity engaged in legitimate laboratory research; (b) products will be handled only by individuals trained in safe laboratory practices; and (c) products will not be administered to humans or animals under any circumstances. We reserve the right to refuse or cancel any order at our sole discretion, including where we believe products may be put to a non-research use.
4. No Medical Claims
Nothing on this website constitutes medical, health, or dosage advice. Statements on this website have not been evaluated by the U.S. Food and Drug Administration. Our products are not drugs and are not intended to diagnose, treat, cure, or prevent any disease.
5. Orders, Pricing, and Payment
All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, limit quantities, and refuse or cancel any order. An order is accepted only when we dispatch the products. Payment is due in full at the time of order through the payment methods offered at checkout.
6. Promotions
Promotional offers, including our Buy One Get One Free (“BOGO”) promotion, apply only as described at the time of purchase: when two or more eligible products are in the cart, the lowest-priced eligible item is discounted in full. Excluded products (including bacteriostatic water) are identified on the website. Promotions may be modified or withdrawn at any time and have no cash value.
7. Shipping, Title, and Risk of Loss
Shipping terms are described in our Shipping & Returns policy, which is incorporated into these Terms. Title and risk of loss pass to you upon our delivery of the products to the carrier.
8. Returns and Purity Guarantee
Because of the nature of research materials, all sales are final except as expressly described in our Shipping & Returns policy (damaged, defective, or incorrectly shipped items).
Purity guarantee. Each lot is analytically tested for identity and purity before release. If you independently test a product you purchased from us and an accredited third-party laboratory reports its purity below 99%, we will replace that item free of charge, or issue a full refund of it at your election. To make a claim, email support@bufsupps.com within 30 days of delivery with your order number and the laboratory report, which must identify the product and lot number. This guarantee is our sole obligation, and your sole remedy, with respect to product purity.
9. Prohibited Uses
You may not: (a) purchase products for human or veterinary consumption or administration; (b) resell products in a manner that misrepresents their intended use; (c) use this website in violation of any applicable law or regulation; or (d) interfere with the operation or security of this website.
10. Disclaimer of Warranties
EXCEPT FOR THE PURITY GUARANTEE EXPRESSLY SET OUT IN SECTION 8, ALL PRODUCTS AND THIS WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUF SUPPS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THIS WEBSITE OR ANY PRODUCT. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. MISUSE OF PRODUCTS CONTRARY TO THEIR RESEARCH-USE-ONLY DESIGNATION IS AT YOUR SOLE RISK.
12. Indemnification
You agree to indemnify, defend, and hold harmless BUF Supps LLC from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your use, handling, storage, or disposition of any product, including any use contrary to its research-use-only designation.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of these Terms or your use of this website shall be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms at any time by posting a revised version on this page with a new “Last updated” date. Continued use of the website after changes constitutes acceptance of the revised Terms.
